Terms of service
These are the terms between you and Rally Club. They apply the moment you make an account, and they are written to be read rather than to survive a court case, which we think is the right way round for a club of eight people who meet on a Tuesday.
We are to be confirmed before launch, company number to be confirmed before launch, trading as Rally Club, at to be confirmed before launch. You can reach a human at hello@joinrallyclub.com.
What Rally Club actually is
We organise recurring group sessions in whichever activities the app is offering when you sign up. A cohort is a small group who meet at the same venue, in the same slot, for 6 consecutive weeks. Its size depends on what we book for it: four players where we book one court, eight where we book two, and however many the room holds where the session is a studio class. Your cohort’s size is shown on its own page. We put the group together, hold the venue time, and run the six weeks.
We are not a booking service and we do not operate venues. The courts and studios belong to the venue, the venue’s own rules apply while you are on their premises, and you are not booking anything from us. What you are buying is a place in a group and the six sessions that group meets for.
Your account
You need to be 18 or over. Give us a real name and a real email, because the other seven people are relying on both. Your sign-in link is yours: do not forward it, and tell us if you think somebody else has it.
One account per person. Cohorts are matched on level, and a second account with a different level on it puts somebody in a group that is wrong for them.
Taking a seat
You pay one week at a time rather than for all 6 up front. Each week is due about 8 days before it, because that is when we book and pay for the court. Payments are taken by Stripe.
What a week costs depends on the venue and the slot, so your cohort states its own price on its page, and Stripe states it again on the payment page before you enter a card. You will never be charged an amount you have not been shown.
If we change the price of a slot, the change applies only to sessions you have not paid for yet, and never to a cohort part way through its run. Your cohort keeps the price it was sold at for all 6 weeks.
There is also a £10 deposit when you join the waiting list. It comes off the last session of your cohort, so pay for every week your cohort runs and it is spent on your own final week. If you do not, we keep it when the cohort closes. It is refundable in full while you are still on the waiting list, and for 14 days from payment whatever else is happening. See the refunds policy for the cases where we will not keep it.
Being invited to a cohort is not the same as being in one. Your place is held while the cohort forms, and the contract for a given session exists once you have paid for that session. Until you pay for your first week we may offer the place to somebody else, though we will tell you before we do.
Nothing is ever charged automatically. There is no stored card and no subscription: every week is a payment you make, and not paying is how you leave.
A cohort needs a minimum number of paid players to run: four where we have booked one court, 6 where we have booked two. Your cohort states its own number on its page. If we cannot get there, we cancel and you get everything back. The refunds policy covers that and every other case where money comes back, including your right to change your mind in the first 14 days.
What we owe you
- 6 sessions at the venue, day and time your cohort was sold on. If a week is called off we will tell you as early as we can, and if you had already paid for it the money goes back to your card without you asking. Where we can find a replacement date we will offer you that instead, and it is your choice which you take.
- A group matched to the level you told us. Level bands are a judgement, not a measurement, and if yours is clearly wrong we will move you rather than leave you in it.
- Court time held and paid for. You never handle the venue booking or pay the venue directly.
- A reply from us within two working days, every time.
What we ask of you
The entire product is that the same eight people keep turning up. Everything in this section follows from that.
- Reply to the reminder. Yes or no, both are useful. Silence is the only answer that leaves a court short.
- Tell us early if you cannot make a week. We will find a substitute. Told on the day, we usually cannot.
- Turn up on time, because the slot is 90 minutes whether you are there for it or not.
- Be somebody the other seven want back. No abuse, no harassment, no coaching people who did not ask.
- Follow the venue’s rules while you are at the venue.
We can remove you from a cohort for a serious or repeated breach of the above. We will tell you why, and we will refund any session you have paid for and not played. We do not keep money as a penalty in any circumstances. The refunds policy covers the rest.
Fitness, injury and insurance
Everything we run is exercise, and exercise carries risk. You are responsible for deciding you are fit to take part, and for telling us about anything that would matter in an emergency. If a doctor has told you not to do this, please listen to them rather than to us.
Play at your own risk. Public liability at the venue is the venue’s, under their own policy and their own terms. We are not providing coaching, supervision or medical cover, and we strongly recommend your own personal accident insurance.
Our liability
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Nothing below changes that.
Beyond those, our total liability to you is capped at what you paid us for the cohort in question. We are not liable for indirect or consequential losses, for a venue closing its doors, or for weather.
You are a consumer, and none of this affects your statutory rights under the Consumer Rights Act 2015. If a session is not carried out with reasonable care and skill, that Act gives you remedies that these terms cannot take away.
Changing these terms
We may update these terms. If a change is material and you have a cohort running, we will email you at least 14 days before it applies to you, and you can cancel and be refunded for the sessions you have not yet played if you would rather not accept it.
Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. Email us first: almost everything is a five-minute conversation that neither of us should be paying anybody to have.
